Dermot O’Brien wins Pension for Recorders

The Supreme Court today finally ruled on the application by Dermot O’Brien for a pro rata pension for time spend as a Crown Court Recorder. This landmark judment will affect a large number of other part time holders of judicial office and will no doubt have a significant effect on the funding of legal services.

The court held that Recorders are in an employment relationship within the meaning of the Framework Agreement on part time work and must be treated as workers for the purpose of the 2000 Regulations.Mr O’Brien is entitled to a pension on terms equivalent to those applicable to a Circuit Judge.
