11:30: ARP, waiver issues and referral fees – Jeremy Barnett, Barrister, St Pauls Chambers

It is quite clear from a number of recent decisions of the SDT that a failure to pay the ARP premium is a serious disciplinary offence.  The seminar will review a number of the published decisions and consider the steps that can be taken to obtain a waiver from ARP obligations and or to mitigate the sanction that might be imposed by the tribunal.

Section 56 of the Legal Aid Sentencing and Punishminet of Offencders Act [LASPO], 2012 prevents the payment of referral fees.  This is a significant peice of legislation that comes into effect in April 2013.  Considerable guidance has been given as to the regulatory approach that will be taken by the SRA.

 

12:00: Alternative Business Structions and Service Quality – Professor John Oakland, Oakland Consulting PLC.

The advent of ABS and ‘Tesco Law’ is radically changing the face of legal services.  There are two mjor forces at play: a market pull towards commoditisation and the pervasive development and uptake of information technology.  Understanding your customers’ needs and delivering services they value will be critical to securing the future success of your busineeses.  This starts with a clear understanding of what quality means to customers and how in turn this should drive changes to people, process and technology in your businesses.  Professor John Oakland, an expert in Quality and stategix Process Management, will discuss how improving service quality will help future proof your business.

 

12:45: COLP and COFA issues – Brian Rogers√جª¬øcompliance partner, Lewis Hymanson Small, Director of Regulation and Compliance Services, Riliance Software Ltd, and Chairman, Regulatory Affarirs Committee, Manchester Law Society.

The new SRA Code of Conduct has been in effect since October 2011; the COLP/COFA regime becomes fully operational on 1 January 2013, nut firms must ensure their systems and proceedures are appropriate and in place now.  Research carried out by the SRA prior to OCtober 2011 found that a substantial number of firms were in breach of the 2007 Code, and would be in breach of the 2011 Code if issues were not rectified; the SRA has said that firms not complying will face tough disciplinary action. The session will consider the regulatory approach being taken by the SRA and the effects of non-compliance.
