THe SRA have reported on their website a number of recent hearings before the SDT concerning disciplinary allegations in respect of failure to pay Assigned Risk Pool premiums following entry into the ARP pool.

Solicitors whose practices are facing financial difficulty, or allegations of misconduct by members of staff should take advice on their own legal position. Recent cases before the SDT show that intervention, administration, or dealing with complaints against members of staff can bring about serious disciplinary charges where solicitors have had no dealings with the issues, and often relied upon others to guide them through the ‘murky waters’ of ‘new outcomes focused’ regulation.√جª¬ø

The SRA seem to have concentrated on various ‘hot topic’s over the last few years, including Miners Compensation, overcharging in PI cases, failure to pay ARP [Assigned Risk Pool] premiums and Litigation Funding [Axiom]. The current focus seems to be on the use of Escrow Services by firms of solicitors, when these have been used in various financial services promotions. √جª¬ø
Solicitors often find that they are aslo subject to regulation by other regulators such as the FCA in these circumstances.

In a High Court Decision published today, the SRA were roundly criticised in the manner of the presentation of their case before the Solicitors Disciplinary Tribunal. However, the decision to stay the case was overturned by Mrs Justice Thirwall DBE, who remitted part of the case back to be heard by a new tribunal.

The SRA have published a detailed response to the latest consultation document on the Referral Fee ban imposed by the Legal Aid, Sentencing and Punishment of Offenders Act 2012 [LASPO] and also held a workshop on 19th November 2012. It is difficult to understand the precise approach that will be taken towards enforcement however, one or two themes do seem to be emerging from The Birmingham Cube.
